2.1. Intellibec provides digital tools and services including:

• AI-powered photo editing and background generation (OptimaPix)

• Website automation and chatbot integrations

• Workflow automation and data processing tools

2.2. Features may be updated, improved, modified, suspended, or discontinued at any time without prior notice.
2.3. AI-generated outputs are provided as-is and may vary in accuracy or quality.

3. User Responsibilities

3.1. You agree to use the platform for lawful purposes only.
3.2. You are responsible for ensuring your use complies with applicable laws in your jurisdiction.
3.3. You agree not to:

• Reverse engineer, modify, or attempt to access restricted systems

• Interfere with the security or functionality of our services

• Upload harmful code, viruses, exploits, or malware

• Use the platform for fraudulent, abusive, or illegal purposes

4. Uploading Content – User Obligations

4.1. You retain ownership of all images, files, and content uploaded to the platform.
4.2. By uploading content, you grant Intellibec a limited, non-exclusive license to process, host, transform, and generate derivative outputs solely for providing the service.
4.3. You confirm that:

• You own or have full legal rights to use the images you upload

• You have permission for any recognizable person featured

• You have rights to any logos, trademarks, or copyrighted elements included

4.4. Responsibility for logos, brands, and trademarks
You acknowledge that if your content contains third-party brands, logos, designs, or trademarks, you are solely responsible for ensuring you have the right to use them.

Intellibec is not liable for:

• Trademark infringement

• Copyright infringement

• Unauthorized use of brand assets

• Legal claims arising from your uploaded content

5. Prohibited Content

You may not upload or generate content that includes:

• Pornography or explicit sexual content

• Nudity involving minors

• Violence, extremism, or hate speech

• Illegal, fraudulent, or harmful content

• Deepfakes of real individuals without consent

• Identity documents (passport, license, etc.)

• Content that infringes copyright, trademarks, or privacy rights

Violation may lead to immediate account suspension.

6. Privacy and Data Use

6.1. Your privacy is governed by our Privacy Policy.
6.2. You consent to the collection and processing of your data to operate the platform.
6.3. User-uploaded photos may be stored temporarily for processing, after which they are automatically deleted per our retention policy.

7. AI Processing Disclaimer

7.1. OptimaPix uses automated systems (AI) to process and generate images.
7.2. AI outputs may contain inaccuracies, artifacts, distortions, or unintended modifications.
7.3. You acknowledge that AI results may not always meet professional or legal standards.
7.4. You remain solely responsible for verifying the suitability of generated images before commercial use.

8. Intellectual Property

8.1. All platform content, software, branding, and design are the intellectual property of Intellibec.
8.2. You may not copy, duplicate, redistribute, or exploit any part of our services without written consent.
8.3. User-generated images remain the property of the user, subject to rights granted for platform operation.

9. Limitation of Liability

9.1. Our services are provided “as is” without warranty of any kind.
9.2. Intellibec is not responsible for:

• Damages arising from misuse of the platform

• Loss of business, revenue, or data

• Errors in generated images

• Copyright or trademark misuse by users

• Incorrect AI interpretations

• The final usage of generated images

9.3. To the maximum extent permitted by law, we disclaim all liability for direct, indirect, incidental, or consequential damages.

10. Indemnification

You agree to indemnify, defend, and hold harmless Intellibec and its owners against any claim arising from:

• The content you upload

• The images generated using your inputs

• Any copyright or trademark dispute

• Misuse of AI-generated results

• Violation of these Terms or applicable laws

This clause protects the company in case a brand or individual initiates legal action.

11. Payments and Credits

11.1. Payments are processed through trusted third parties such as Stripe or PayPal.
11.2. Intellibec does not store full credit card details.
11.3. Purchases of credits or subscriptions are non-refundable unless otherwise required by law.
11.4. Fraudulent or abusive chargebacks may result in account suspension.

12. Account Termination

12.1. We may suspend or terminate accounts that violate these Terms.
12.2. Upon termination, your access to the platform is revoked.
12.3. Obligations such as payments, indemnification, and legal compliance survive termination.

13. Changes to Terms

13.1. We may update these Terms at any time.
13.2. Changes take effect upon posting them on this page.
13.3. Continued use of the platform constitutes acceptance of the updated Terms.

14. Governing Law
